If the location is deemed readily accessible and it complies with the height limitation set forth in 404.8(A), it should be acceptable.

I am not sure accessibility would really be a huge issue. You should have room for a side reach (9"-54"). Most pool gates would not have that access since the latch is usually on the inside (over an obstruction) and the gate swings out. I am not sure how a wheelchair bound person even gets in the pool fence.

Having an electrically opened gate with an asccessible switch sure seems to defeat those 53" high latches.
