Rumor has it that the DCA/FBC is delaying the adoption of the 2008 NEC until September of this year. I have a call in to Mo Madani and Betty Stevens for confirmation.

No one from the Electrical TAC can seem to give me a straight answer....

I sent an email to every member of the Commission.I haven't received a reply to the second part yet. Start at the bottom and work up.

I understand fully that the actual Electrical Code in Florida is the FBC. The Commission has decided to use NFPA 70 ( NEC ) as it's basis and has the authority to strike out whichever portions it decides to. I am in full agreement with this. This is what was done by placing an exception in the FBC for exemption of GFCI for 1&2 Family pools that are direct wired. The problem that arises is Article 110.3 (B) Installation & Use: Listed or labeled equipment shall be installed and used in accordance with any instructions included with the listing or labeling.

Is the Commission saying to ignore the Listing of the Equipment or are you in agreement that if the Listing requires GFCI protection that it SHALL be installed on 1 & 2 Family direct wired pool pumps?
I just want to do what is right and will stand up in Court if there is ever a problem. This is a very unique issue.

This is a question for Mark Turner. Lets get past what what was done to diminish a code and get to the problem....Why?

1. Mark I would like to ask what the problem is with GFCI protecting a hard wired pool pump motor?

2. Why is this problem only applicable to residential pools and not commercial?

I think that the rule has passed but there is a 45 day time period for public comments before it becomes effective. Hence the delay.

I have a message from Mo Madani on my voice mail from earlier today. According to him, the FBC approved the adoption of the NEC on June 9th. The notice of change will be published within 21 days, leaving August 1st as the anticipated adoption date.

Then he said something odd. He claims the individual AHJ's can start enforcing the 2008 NOW. He says the 2008 NEC has been approved by the Commission effective June 9th and it is with the discretion of the AHJ as to when to start enforcing it.

I will post the exact transcript of his meassage in the AM when I have more time....
