I have a few questions regarding how jurisdictions have implemented Florida Statute 255.2575 as follows:
F.S. 255.2575(2) - All county, municipal, school district, water management district, state university, community college, and state court buildings shall be constructed to comply with a sustainable building rating system or a national model green building code. This section applies to all county, municipal, school district, water management district, state university, community college, and state court buildings the architectural plans of which are commenced after July 1, 2008.
A “sustainable building rating system” & “national model green building code” is defined in F.S. 255.253 as follows:
F.S. 255.253(7) - “Sustainable building rating or national model green building code” means a rating system established by the United States Green Building Council (USGBC) Leadership in Energy and Environmental Design (LEED) rating system, the International Green Construction Code (IGCC), the Green Building Initiative’s Green Globes rating system, the Florida Green Building Coalition standards, or a nationally recognized, high-performance green building rating system as approved by the department.
1. Has your local jurisdiction adopted an ordinance or other administrative directive defining, regulating, & enforcing the above statute?
2. If so, are you allowing any of the “rating systems” to be used or have you identified one “standard” or “rating system” as the accepted & approved method for complying with the statute?
3. What department or individual in your jurisdiction is responsible for monitoring, reviewing plans, & conducting inspections under the approved “rating system”?
4. Is the building department (BCAIB licensed persons) responsible for enforcing this statute?
5. Where does the funding for training, education, certification, etc. come from to enforce this statute & ensure compliance?
